1. General rules

1.1 These Terms of Use set out the terms and conditions for the conclusion and performance of a Contract on the Online Shop www.innosenta.com the purchased goods between the Seller SIA "spring breath", reg.no.40203384113 , and the Buyer - online shop www.innosenta.com  clients.

1.2 The Buyer accepts and agrees to these Terms and Conditions when it has read them, by ticking the box at the time of purchase.

1.3 The Contract between the Buyer and the Customer is established at the time when the Buyer has ordered the Goods and made payment for them, correctly filling in the information required for the order.

2. Ordering and payment

2.1 The Buyer shall order goods from the Online Shop using the built-in technical features.

2.2 The Buyer shall specify its contacts and the method of delivery. All Personal Data submitted by the Buyer shall be subject to the terms of the Privacy Policy.

2.3 Each order placed by the Buyer shall be stored in the Seller's database.

2.4 The Buyer shall be informed of the order confirmation by sending a notification to the e-mail address provided by the Buyer.

2.5 The prices of the goods in the Online Shop are quoted in Euro including VAT (if applicable).

2.6 The Buyer may pay for the ordered goods by internet banking (bank link) or by payment card.

2.7 The Customer must select their preferred online bank or enter their payment card details in the payment template and follow the on-screen steps to make payment.

2.8 When the Seller receives payment for the Goods, the Buyer will receive an email that the order has been confirmed.

2.9 The Bill of Lading shall be sent to the Buyer's e-mail address only, shall be electronically generated and shall be valid without signature.

3. Delivery

3.1 The Goods shall be delivered to Omniva or DPD parcel machines in Latvia at the prices indicated at the time of payment. Orders over EUR 35 are delivered without additional delivery charges (within Latvia).

3.2 Before making payment, the Buyer shall select the most convenient delivery method and the specific parcel machine from the available list of parcel machines.

3.3 Delivery is also possible in other European countries to the following prices (excluding VAT), delivery prices may vary depending on the prices charged by suppliers:

3.4 Specific delivery prices to European countries are calculated at the time of placing the order and specifying the chosen delivery address, in accordance with the prices quoted by the suppliers.

3.5 If the Buyer fails to collect the goods from the parcel office within the specified time, which is notified to the Buyer by text message and/or e-mail, the goods are returned to the Seller, the order is cancelled. The Buyer shall be refunded the money paid for the Goods in the amount of 50 % of the purchase price. At the Seller's discretion, if the goods have not been damaged, the Buyer may be credited the full purchase price less delivery costs and €10 for processing the returned order.

3.6 Delivery is also possible by courier to a specific address specified by the Buyer, both in Latvia and other European countries, these are indicative prices (excluding VAT), delivery prices are subject to change in accordance with the prices set by suppliers:

3.7 Specific delivery prices are calculated on request. If the Buyer wishes delivery by courier to a specific address, the Buyer must order the Goods by contacting the Seller by e-mail: info@innosenta.lv

3.8 The Buyer is responsible for providing a completely accurate and correct address and is responsible for collecting the goods at that address. If the Buyer is not at the address at the time of delivery and does not collect the Goods at the address, the Seller shall hand them over to another person at the address, the Goods shall be deemed to have been delivered and the Buyer shall not be entitled to make any claim against the Seller in respect thereof.

3.9 The terms of delivery are provisional and may be subject to change depending on changes in the provision of services by the suppliers of the goods or other objective circumstances.

3.10 Delivery of the Goods may be delayed due to unforeseen circumstances beyond the Seller's control. The Seller shall notify the Buyer if the delay is caused by the Seller. The Buyer may exercise the right to withdraw from the contract for the purchase of the Goods.

3.11 The Seller shall not be liable for any delay in delivery of the Goods due to objective reasons, including the fault of third parties or the Buyer.

3.12 When the Goods are handed over to the Buyer, liability for the Goods shall pass to the Buyer.

4. Return of goods

4.1 If the Buyer is a consumer (natural person), in accordance with the Consumer Rights Protection Act, the Buyer has the right to withdraw from the Purchase Agreement within 14 days without giving any reason. The right of withdrawal will expire after 14 days from the date of receipt of the goods. If the expiry date falls on an "official" public holiday, the right of withdrawal must be exercised up to and including the working day following the expiry date.

4.2 The Buyer must notify the Seller of the cancellation in writing by e-mail to info@innosenta.lv. The withdrawal can be made in free form or using this withdrawal form.

4.3 Within the period provided for the right of withdrawal, the Buyer shall return the goods to the Seller at the Omniva kiosk in Sigulda, Vidus iela 1, (ELVI supermarket kiosk). The deadline will be met if the Buyer returns the goods before the end of the 14-day period.

4.4 Returned goods must be unused and in the same condition as when they were sent. 

4.5 Upon receipt of the eligible returned goods, the Seller shall refund the money paid to the Buyer to the Buyer's account from which the payment was made, including the return of the delivery costs (except for additional costs incurred because the Buyer has chosen a delivery method other than the cheapest standard delivery method offered by the Seller).

If the Buyer has previously exercised the right to withdraw from the Innosenta Products, the Seller reserves the right to charge the delivery and billing costs associated with the exercise of such withdrawal in respect of subsequent withdrawals.

4.6 If the Buyer withdraws from the Purchase Contract before the Goods have been dispatched to the Buyer, the Buyer must notify the Seller in writing by e-mail: info@innosenta.lv. The order is cancelled.

4.7 The Seller shall exchange or accept the return of goods of inadequate quality with a refund to the Buyer, in accordance with the provisions of the Consumer Rights Protection Law. The exchange and refund shall not apply to goods which have been damaged intentionally or negligently, if the conditions of use or storage of the goods have been violated, or if the goods have been used improperly or not for their intended purpose.

5. Rights and Obligations of the Purchaser

5.1 When ordering goods, the Buyer must provide accurate and correct Personal Data.

5.2 The Buyer shall have the right to cancel the order and withdraw from the Contract, exchange or return the purchased goods in accordance with the procedure set out in these Terms and Conditions.

5.3 The Buyer shall comply with these and other terms and conditions of the Seller, as well as with the laws of the Republic of Latvia.

5.4 The Buyer shall pay for and accept the Goods ordered in accordance with these Conditions.

6. Rights and Obligations of the Seller

6.1 The Seller shall execute the Buyer's orders in accordance with these Conditions.

6.2 The Seller will only contact the Buyer for order fulfilment or marketing purposes to the extent that the Buyer has permitted.

6.3 The Seller undertakes to respect the Buyer's privacy and the protection of the Buyer's Personal Data in accordance with the GDPR and other applicable laws and regulations.

7. Final provisions

7.1 These Conditions shall be binding on the Buyer and the Seller.

7.2 All disputes arising between the Buyer and the Seller shall be settled by negotiation.

If no agreement is reached within 30 (thirty) calendar days, the dispute shall be settled in accordance with the procedure established by the laws and regulations of the Republic of Latvia.
